DIVORCE

 

This involves formally ending your marriage

What work we will undertake for you?

We can undertake work in relation to the following for you.

  1. Provide advice on the Divorce Petition, or how to respond to it

  2. We can assist you with completing a Divorce Petition, or respond to it on your behalf

  3. Negotiate with the other side where necessary

  4. Deal with any financial issues that may arise.

  5. Help you obtain a Decree Nisi

  6. Help you obtain a Decree Absolute

 

Time frame

A non-contested Divorce will normally be completed within six months of the Petition being filed with the Court. This period could be longer if the financial negotiations are complex, or the parties cannot agree without the assistance of the Court.

 

Fees

The Solicitor representing you may agree a fixed fee with you in relation to a non-contested Divorce. The fixed fee agreed would be exclusive of VAT.  Any negotiations for a Financial Settlement would fall outside any fixed fee.

   c)   £22.00 per telephone call, exclusive of VAT. Any telephone call exceeding 6 minutes will be charged at our standard hourly rate.

   d)   £11.00 per letter in, exclusive of VAT.

 

   2.  A charge for all work undertaken in relation to this matter by a Trainee Solicitor. Our hourly rates are.

 

   a)   £125.00 per hour, exclusive of VAT

   b)   £12.50 per letter out, exclusive of VAT

   c)   £12.50 per telephone call, exclusive of VAT. Any telephone call exceeding 6 minutes will be charged at our standard hourly rate.

   d)   £6.25 per letter in, exclusive of VAT.

 

Disbursements

  1. Identification of client - £10.00, plus VAT

  2. TT Fee - £30.00, plus VAT

  3. Barristers fee – dependant on the barristers level of experience. All fees will attract VAT – this will be discussed with you if the need for a barrister arises.

  4. Court fee – £550.00 – (no VAT) – if any other court fees are required they will be discussed with you at the time, prior to being incurred. These again will carry no VAT. This fee may be waived in full, or part, depending on your personal financial circumstance.

Any other disbursements will be discussed with the client prior to being incurred.

 

SEPARATION

 

This involves formally ending a relationship and deals with who retains what assets.

What work we will undertake for you?

We can undertake work in relation to the following for you.

  1. Advise you in relation to your rights in relation to the separation

  2. Negotiate with the other party to reach an agreement on separation.

  3. Represent you at Court, if necessary

  4. Draft and complete, or advise on, a completing the Separation Agreement.

 

Time frame

 

This can vary from case to case and depends on how easily an agreement can be reached. We will advise you in relation to this at the initial meeting and subsequently throughout the matter.

 

Fees

The Solicitor representing you may agree a fixed fee with you in relation to a simple Settlement Agreement (no negotiations). The fixed fee agreed will be exclusive of VAT.  Any Negotiations for Financial Settlements shall fall outside any fixed fee.

  1. Advise you in relation to your Financial Settlement and the amount you may be entitled to.

  2. Represent you at Court, if necessary because an agreement cannot be reached.

  3. Daft, or advise on, the proposed settlement.

 

Time frame

This can vary from case to case and depends on how easily an agreement can be reached. We will advise you in relation to this at the initial meeting and subsequently throughout the matter.

 

Fees

All work for Financial Settlements is charged as follows.

   2.   Negotiate with the other party to try and reach an agreement in relation to the child/children.

   3.   Advise you in relation to the Orders you are able to apply for and the Orders the Court can make.

   4.   Represent you at Court, if necessary because an agreement cannot be reached.

   5.   Daft, or advise on, the proposed agreement and/or Order of the Court.

 

Time frame

This can vary from case to case and depends on how easily an agreement can be reached. We will advise you in relation to this at the initial meeting and subsequently throughout the matter.

All work for Child Arrangements is charged as follows.

  1. A charge for all work undertaken in relation to this matter. Our hourly rates are.

   1.   Advise you about possible proceedings taken by the Local Authority.

   2.   Advise and represent you if proceedings are taken.

   3.   Advise you in relation to the Orders a Court can make.

 

Time frame

This can vary from case to case and depends on how easily an agreement can be reached. We will advise you in relation to this at the initial meeting and subsequently throughout the matter.

 

Fees

All work in relation Care Proceedings are Legally Aided so there will be no charge to you as the client.

DOMESTIC VIOLENCE

 

This involves dealing with issues of Domestic Violence.

What work we will undertake for you?

We can undertake work in relation to the following for you.

   1.      Advise you in relation to your rights and entitlements in relation to your protection from Domestic Violence, or how to      defend yourself in light of an allegation of the same.

   2.      Negotiate with the other party to try and reach an agreement in relation to preventing Domestic Violence continuing, or defending yourself against allegations in relation to the same.

   3.      Advise you in relation to the Orders you are able to apply for and the Orders the Court can make, or opposing the same.

   4.      Represent you at Court, if necessary because an agreement cannot be reached.

   5.      Daft, or advise on, the proposed agreement and/or Order of the Court.

 

Time frame

This can vary from case to case and depends on how easily an agreement can be reached. We will advise you in relation to this at the initial meeting and subsequently throughout the matter.

 

Fees

All work in relation to domestic violence is charged as follows. The Solicitor representing you may agree a fixed fee with you in relation to a simple Application, or defence of the same (no negotiations). The fixed fee agreed will be exclusive of VAT.

POST NUPTUAL AGREEMENTS, POST NUPTUAL AGREEMENTS

AND COHABITATION CONTRACTS

 

This involves agreements about what will happen in the event your relationship ends.

What work we will undertake for you?

We can undertake work in relation to the following for you.

  1. Act on your behalf in connection with your Pre-Nuptial Agreement and and/or your Post Nuptial Agreement, or you Cohabitation Agreement

 

   2.  Advise you on your Pre-Nuptial Agreement and and/or your Post Nuptial Agreement, or you Cohabitation Agreement.

 

   3.   Negotiate with the other side in relation to your Pre-Nuptial Agreement and and/or your Post Nuptial Agreement, or you Cohabitation Agreement if necessary

 

   4.   Re draft or make changes to your Pre-Nuptial Agreement and and/or your Post Nuptial Agreement, or you Cohabitation Agreement

 

   5.   Deal with the execution of your Pre-Nuptial Agreement and and/or your Post Nuptial Agreement, or you Cohabitation Agreement

 

Time frame

The following time frames apply to Pre-Nuptial Agreement and Post Nuptial

  • Pre-Nuptial Agreement – within the 28 days prior to the date of your Wedding

  • Post Nuptial Agreement – within the 28 days after the date of your Wedding

 

A Cohabitation contract depends on the time it takes to reach an agreement but should, ideally, be completed before you star living together.

Fees

The Solicitor representing will agree a fixed fee with you in relation to a simple Agreement The fixed fee agreed will be exclusive of

VAT.

  • Pre-Nuptial Agreement - Three Hundred Pounds (£300.00) plus VAT of Sixty Pounds (£60.00) totalling Three Hundred and Sixty Pounds (£360.00)

  • Post Nuptial Agreement - Three Hundred Pounds (£300.00) plus VAT of Sixty Pounds (£60.00) totalling Three Hundred and Sixty Pounds (£360.00)

  • Co habitation  Agreement - Three Hundred Pounds (£300.00) plus VAT of Sixty Pounds (£60.00) totalling Three Hundred and Sixty Pounds (£360.00)

 

If the matters are complicated the Fee Earner dealing with the matter will advise you that they fall outside the above fees and the work will be charged in line with the following.
